Plain-English summary: Use Nearby & Now to discover local events and news. Don't misuse the service, don't scrape our content, and be aware that we aggregate third-party information and cannot guarantee its accuracy.
1. Acceptance of Terms
By accessing or using Nearby & Now (the "Service"), including our website at nearbyandnow.com, our web app, or any mobile application we publish, you agree to be bound by these Terms & Conditions ("Terms").
If you do not agree to these Terms, please do not use the Service. We may update these Terms from time to time; continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.
2. Description of Service
Nearby & Now is a hyperlocal event and content discovery platform. We aggregate publicly available information from third-party sources — including event listing platforms, news outlets, community forums, and social media — and present it in a single feed relevant to your chosen location.
The Service is provided on an "as is" and "as available" basis. We make no representations that the Service will be available at all times or that all content will be accurate, complete, or up to date.
3. Eligibility
- You must be at least 13 years old to use the Service.
- If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
- By using the Service, you confirm that you have the legal capacity to enter into a binding agreement.
4. User Accounts
Creating an account is optional. If you choose to create one:
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and up-to-date information.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorised use of your account at hello@nearbyandnow.com.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Scrape, crawl, or systematically extract content from the Service using automated means without our written permission.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Transmit any harmful, unlawful, defamatory, or otherwise objectionable content.
- Interfere with or disrupt the integrity or performance of the Service.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Use the Service for any commercial purpose without our prior written consent.
6. Third-Party Content
The Service aggregates content from third-party sources including, but not limited to, Eventbrite, Ticketmaster, Reddit, Facebook, Google Places, Meetup, Viator, local news RSS feeds, and community forums.
We do not own, control, or endorse third-party content. We make reasonable efforts to display accurate information but:
- Event details (dates, times, prices, venues) may change or be cancelled at any time.
- We are not responsible for the accuracy, completeness, or legality of third-party content.
- Links to external sites are provided for convenience; we do not endorse their content or privacy practices.

7. Affiliate Links and Commercial Content
Some event listings may include affiliate links (for example, links to Viator experiences). If you purchase a ticket or book an experience through such a link, we may receive a small commission at no extra cost to you. Affiliated content is clearly marked within the app.
8. Intellectual Property
All original content, features, and functionality of the Service — including our name, logo, design, and code — are owned by or licensed to Nearby & Now Ltd and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from our original content without our express written permission.
Third-party content aggregated by the Service remains the intellectual property of its respective owners. We display it under fair use principles or in accordance with the terms of each source platform.
9. Location Data
The Service uses your location — either entered manually or obtained from your device GPS (with permission) — solely to show you relevant local content. We do not sell your location data or share it with advertising networks. See our Privacy Policy for full details.
10. Notifications and Email
If you subscribe to our weekly digest or enable push notifications, you consent to receive communications from us. You may opt out at any time:
- Email: Click "Unsubscribe" in any email we send.
- Push notifications: Disable notifications in your device or browser settings.
11. Disclaimers
To the fullest extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components.
- We do not warrant the accuracy, reliability, or completeness of any content on the Service.
- Your use of the Service is at your sole risk.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Nearby & Now Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to loss of data, loss of revenue, or loss of goodwill.
Our total liability to you for any claim arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £50 GBP.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify and hold harmless Nearby & Now Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.
14. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice — including for breach of these Terms.
You may close your account at any time by contacting us at hello@nearbyandnow.com. Upon termination, your right to use the Service ceases immediately.
15. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice within the app or by email. The "Last updated" date at the top of this page will always reflect the current version. Your continued use of the Service after changes take effect constitutes acceptance.
